The key element in insurance claim investigation is the knowledge of elements that can identify cases that are appropriate for insurance subrogation, i.e. identifying third parties that are liable in the case at hand.

Good insurance subrogation investigation requires that the investigator look beyond what the worker did and consider other factors, which may include things like a lack of guards on a machine where a serious injury occurred, the lack of a slip resistant tile on a floor, or the failure of a machine designer to design a component so that a guard would not have to be removed for maintenance of the machine.

To be successful in identifying the subrogation aspects of a insurance claim investigation, one must begin by first thinking about what's wrong with the design as opposed to what the worker did wrong.

The insurance investigation agent must have a good grasp of mechanics and the legal aspects of insurance subrogation issues. An important aspect subrogation insurance claim investigation includes knowing that manufacturers must predict operations that operators of machines might perform and the hazards associated with each of the tasks. The designer performs a risk assessment and if the risk is intolerable, the risk must be reduced by utilizing established safety hierarchies in the following order.

  A. If possible, eliminate the hazard through design
  B. Create a guard against the hazard
  C. Adequately warn the user about the hazard
  D. Attempt to train the user to avoid the hazard
  E. Recommend personal protective equipment
